Can Similar Assets Lead to Your Game Being Taken Down?

Hello, I’m currently creating a FPS game and it follows some concepts from other games.

One of which is a particular gun model from OverWatch.

Are they too similar? Will Roblox take down my game because of the resemblance?

Not really, although there is high resemblance you did not actually copy the gun. There’s quite a few top games which models possess very high resembles or actual copies of assets from games. Not to mention models, some games are even based solely on anime or TV shows.

Unless you’ve got evidence that can be presented to demonstrate you’ve modeled it from scratch than you may have a fighting chance had a DMCA notice be used against you.

Tracing however isn’t a loophole, if blizzard wanted to DMCA you for mimicking their design than they’re legally allowed to do so. You’re better off parodying the design than to mimic it.

It’s an identical representation of the original asset. That’s the definition of copying.

Quite a few top games were also taken down because some IP holders weren’t happy with us using their stuff without permission.

Usually without permission from the official right holders, so they can be taken down at any time.

There are some differences here and there from the original model but yeah it does share quite a resemblance, would he still be liable for that? Some games still remained, all they did was change their names.

Apologies for the lack of information regarding legal issues but thank you for clearing that up.

The only notable differences would be the textures, the model itself is undeniably a direct copy to the original.

While that is true, isn’t this particular example by blizzard a parody of a magnum? Is a parody guaranteed the same protection as an original asset would be given?

I’m not an expert so these questions definitely go above my paygrade. From what i understand Blizzard owns/patented the gun’s unique design. If they think the weapon Kazurei made is too similar to their own, they may request a DMCA takedown, which could result in a strike. The chances of that are very slim, but they have that right.

The best way to combat this is by instead of tracing one gun, you model various features from multiple guns and combine them together to create something unique. Google “Fantasy gun” and you’ll have a great time.

To me at least, it looks too similar. The mesh is nearly identical, the main difference is the texture. Would Roblox take down your game? No one knows for sure. If you have to ask the question though, it’s best to change it.

It’s in good practice to avoid copying copyrighted content, instead take inspiration but make it your own.

The top of the barrels are also somewhat different, along with the area under the barrel being thicker (though less noticeable). There’s also more cogs on the gear thing, which are differet in shape.


EDIT: Most people won’t look at that and would say that it’s identical, you could always just point that out if that happens though. It’s, in no way, a good idea to have something that similar, though you could email the actual owners of the asset and say if they’re too similar. In the end, games don’t get taken down for having similar/the same assets. They get taken down because they have that but do not have legal permission to those assets. If you get legal permission (somehow), that’s a different matter entirely. :slight_smile:

By the definition of the word you are correct, but i think you understand what i was trying to imply.

The mesh is similar, but the colors aren’t. I don’t think ROBLOX will take it down.

However, you should probably listen to maplestick on this one. There still is a chance ROBLOX can take it down.

It’s generally a bad idea to 100% copy something. While you can take inspiration from the Overwatch gun design, you need to put your own spin on it too. Yes, your game could get taken down for this.

Also, before you put your time and energy into something and you’re unsure if what you’re doing is legal, you might want to ask before you start making it.

I’ll be making whole different designs as precaution.

Like iiOwenBloxx said it is way too similar, the only difference I can see here and in my mind is probably the length and the colour, if I were you I would just create my own from scratch, to avoid getting a strike.
