DMCA System accepting false claims

I’ll agree with you here. Claims is a highly powerful new feature that instantly takes peoples’ creations off-sale/strikes their accounts as soon as claims are submitted and it seems there’s undeniable abuse going on here.

Half heads are not original content whatsoever unless they have special, unique designs, so it’s pretty much fair game for everyone. Since Roblox doesn’t even review the claims here there’s a high potential for abuse, and this user can clearly not be considered trustworthy. I’d recommend considering removing this user’s permission from the Claims feature @frogprinxe

Apart from this, this report should (and hopefully will, in due course) be locked, as it’s devolved into bitter arguments that are not appropriate for the forum.

Thank you. I wouldn’t mind this thread being closed, as long as agents re-review what is considered original content. I apologize if I came off as threatening previously, I was really just upset at the whole ordeal, that someone can stoop this low to the point where they are giving others strikes to others, acting like they’ve invented a half cut spheroid.

If this thread is read through, please re-review the claims sent by raskolibov. I am currently on set to have 8 permanent strikes without being able to have any course of action.

Not only this, but the item they are claiming with seemingly does not exist.

It exists, it’s this bundle: https://www.roblox.com/bundles/131985978001123/Half-Head

They need to fix that. Anyhow, I’ll await a response for this thread and original content.

DMCA is a legal process. This isn’t something for Roblox to fix or not fix, they need to err on the side of accepting claims when in doubt. It’s up to @raskolibov and @HalfHeadStore to settle this in court, with their attorneys, based on the PII in their original notice/counter-notice.

Saying it again: DMCA isn’t a Roblox process, it’s a legal process.

If anyone is filing a claim illegitimately, they’ll be responsible for lost revenue, legal fees, and punitive fees.

The resolution to this issue is court. Consult a copyright attorney. That is how this system is designed to be used, contested, and challenged. It is a legal procedure.

You are correct that it is a legal process. But that legal process is challenged during a Rights Manager claim. This is what I’m referring to. The connotations of this system being broken are completely malicious and can cause catastrophic error to the platform.

This is what they should’ve received when they sent me a DMCA on a sphere. It shouldn’t have gone through, and this was previously fixed a couple months ago.

Items, games, etc can be removed for weeks because you had a basic object included that someone had previously uploaded to an ID verified account. This is not how it should be.

Alongside this, the second error is that users cannot deny these claims while they are banned, making any claims sent during this time irrefutable. This is complete abuse of the system.

You’re straight up two-faced. You were out here helping with false DMCA claims and getting half-heads taken down, now you’re making the same garbage and false DMCA’ing people yourself? You’re no better than the people you pretended to be against. Total joke.

  • All the bundles I’ve created fully comply with the current Marketplace policies — 100%.

  • Contrary to popular belief, when I use Claims through the Rights Manager, it doesn’t result in immediate action against their accounts. They’re simply given a time frame to take action themselves.

  • I’m defending my rights. Using the Claims feature against someone who stole my work is completely justified. And if they want to challenge it, the system allows them to do that — and most of the time, it actually results in a decision against me (they dispute it and Roblox accepts it). So I don’t even consider Claims to be that strong for this specific reason.

  • Their account getting terminated isn’t my responsibility, and I didn’t cause it. Clearly, several other creators must’ve also realized their rights were being violated, which is why this particular user got hit with so many DMCA strikes that their account was eventually deleted.

Except you left out the part where you sent 7 strikes after they were already terminated, knowing full well they couldn’t respond or counter them. That’s not “defending your rights", that’s abusing the system when the other person literally has no way to fight back.

And let’s not ignore the fact that some of the heads in your group have been using that same floating method with dots that you’re suddenly striking others for. If it’s such an obvious violation, how come it’s magically fine when your group uses it? Kinda two-faced, don’t you think?

You can dress it up as “justified” all you want, but the reality is you took advantage of the timing, stacked Claims when they couldn’t defend themselves, and now you’re acting like it was all clean and fair. It wasn’t.

It’s because they violated my rights 7 times. Each item counts as a separate claim in the system. Since you’re not part of the program, I’ll be understanding about your perspective.

Show me one (1) dynamic head I uploaded that floats — because that’s not true at all.

Oh wait… maybe you’re right.. people are copying your work and not giving credit, they really should stop… Oh! Wait! Where have I seen this before!

Almost like you’re copying the same people you’re reporting in an attempt to steal their funds and run off with money you’ve made breaking the Terms of Service. What a surprise, bravo Raskol.

I have other half head creators complaining to me about him doing the exact same thing  let’s start a PM about this

You’re actually being really funny right now — because the exact creator you mentioned is the one stealing my friend’s design. I’m not sure when they’ll be sending the DMCA, but I’ve already notified them about it.

And if you take a look at their catalog, you’ll see they’ve stolen tons of different models too:
https://www.roblox.com/catalog?Category=1&CreatorName=asdoiwt14&salesTypeFilter=1&IncludeNotForSale

Also, I don’t know much about the heads you’re comparing — but I did check the items uploaded by that stealer, and none of them are even relatively close to what I made. Not at all.

So let me get this straight, your entire defense is basically “they stole from my friend, so it’s totally fine that I turn around and do the same thing”?

That’s not how it works. You don’t get a free pass to copy someone else’s designs just because you think they’re copying your friend. If you actually cared about originality and “defending rights,” you wouldn’t be playing this weird game of who stole from who, you’d be holding yourself to the same standard you expect from everyone else.

You forgot to read the last two sentences :wilted_flower:

I’ve already compared the two, you can tell how similar they are. You’re trying to discredit him by calling him out for “stealing designs” when your both creating practically translucent heads with the same looking appearances.

drop the links to the compared assets…

Wow, you made your head slightly wider, congrats, why don’t we give you an award for originality, my brave turkish soldier

I created all the bundles I uploaded from scratch — I can even count the polygons on the head model of the creator you mentioned, while mine looks smooth in comparison.

Since you stole it, you probably already know that Roblox’s default head mesh has flaws. I model my own head mesh in Blender, and if you import my mesh into Blender, you can clearly see the perfection — something that doesn’t exist in the other asset, because they just straight-up rip Roblox’s default head. On top of that, it’s kind of ugly — they slightly caved in the bottom part.
