I want to send a counter-notice because I was the one to model and texture this item, which makes the item fall under fair use. However, I’m no lawyer, and I don’t know what exactly I have to send to copyright_agent@roblox.com.
I know I have to email them a bunch of a bunch of legal jargon, so if anyone could provide a tutorial/template, that would be greatly appreciated!
You cannot counter Roblox DMCAs, they will ignore you.
My friend, however, did get a custom response from a higher up when he sent a counter notice against Roblox.
“Thank you for your message. The DMCA is a legal framework that allows third-party rightsholders to send requests to online service providers to remove infringing content hosted by the provider. Roblox is not a third-party rightsholder in this case given that the removal pertains to infringement of Roblox’s intellectual property on its own platform, and therefore we reserve the right to treat counter-notices as appeals of a moderation decision. As such, we have reviewed your appeal and as mentioned previously, Roblox believes that removal was appropriate here and will not be restoring the content in question.”
