RoA past legal deadline

Hello,

I’ve “recently” made a RoA request and based on where I live, the legal limit for an answer is 30 days (time limit is covered by 2 separate laws). I opened a new ticket pointing to the old ticket to see if it could speed up the process but I’m still being ghosted.

Roblox is currently breaching 2 regulations. Ticket IDs provided in private message

being nice and threatening usually works

^ isn’t roblox but it’s general advice for big companies

Unfortunately I sent something similar 26/11 and it’s still being ghosted. Last message from Roblox was 18/11

I made a new request 7 days ago, and still being ignored. Even wrote to the privacy email directly around the time of my previous reply and that one is also being ignored.

I added the 2 ticket IDs in the private message. This is all feeling illegal to ignore LEGAL RoA requests

Yeah Roblox is known to not listen to legal documents, or treat them with care at all.

Many people in the past have had DMCA/Copyright takedowns thrown out because “[Roblox] can’t control what people have on their hard drive” or even just because they’re submitting too many (valid) takedown requests

I’ve had one of my own DMCA tickets gone missing entirely. Support themselves told me that it didn’t exist, not even a few months after it was sent. Whether that’s their system randomly deleting tickets or someone on support deleting it themselves is up to interpretation.

I don’t know why this is a surprise to anyone considering Roblox has shown on many occasions to believe, and often prove, that they’re above the law (see also: lying in court on multiple occasions)

If you have the time and money, try talk to a lawyer. You may be able to get something out of this, either money or publicity for this kind of thing happening (because you are not the first and will not be the last)DMC

Being ignored for months now when requesting to see my Data. Here’s 3 new tickets

  • #159216159
  • #139788258
  • #147468677

That makes a good pattern along with everything else for potential legal actions

Hello,

It may not be a bug, but it is a HUGE LEGAL problem.

Hey @koaffle,

So I did get an answer from the support but it was completely irrelevant and useless. I followed up with them and been waiting since your reply.

Can you do something with that?

Based on my laws, the agent should assist with my request instead of dismissing it as he’s been doing for months now.

If I brought this in court, I would win my case against Roblox. I have enough to evidence to make a pattern of ignoring tickets, going past legal deadlines after acknowledgement and negligence

roblox isnt subject to canadian laws but sure :face_vomiting::broken_heart:

Based on what you said, every user should be able to make RoA requests based on California’s CCPA/CPRA laws.

Why would Roblox need you to ID verify that you are in a country that allows for RoA if the governing law is in California, a state that has strong laws about it?

EDIT: Even under california’s law there is a 45 days deadline with a possible 45 days extension if notified. Totalling 90 days, which we’re way past here. No matter where I go to court against Roblox or under which jurisdiction, they are in the wrong here

Ignoring an RoA request? Dang. Did you include the legal references in the contact?

Either way it’s a big concern. I do recommend you to carefully choose how to proceed though. Taking direct action yourself can create a huge and lengthy process. You might instead be able to report this to an organisation who can handle this for you, if that suits you better.

Make sure to get actual legal advice before doing anything big.

Absolutely, the section for each applicable law was mentioned in each request. Specifying the applicable deadline and others applicable.

Yeah since I’m in Quebec I have the choice of 2 organism. PIPEDA or CAI. I think for CAI (Quebec) it would be too late as I need to file a complaint within 30 days of the request, but PIPEDA (Canada) allow for a longer timeline, I think up to 6 months iirc

I would definitely go through one of these organism if I go on with this
