Roblox sending false DMCA takedowns

I can’t believe I have to make this post, but there is a Roblox entity filing takedowns on every item with the name “Dominus” or “Domino”.

DMCA takedowns severely affect peoples accounts, and with enough warnings, lead to permanent terminations.

These items are clearly not exact copies in any capacity, and I’m sure whoever is sending these takedowns willingly realizes this.

Like, are we serious? Do any of you think this resembles the Dominus Rex 1 to 1?

Expected behavior

All of these malicious takedowns should be reverted, and at the minimum items that do not resemble limiteds should be appealed, items that blatantly copy Roblox’s material should be banned under the reason of “Spam”, not an IP violation.

Are you implying that roblox themselves are filing these takedowns? Or is the title of this post in error

It’s quite literally Roblox. I’ve checked all available information, there’s no other way somebody had the meshes of all these items before the user would of. There’s no way to forge Roblox’s name either, any font from a fake group would of shown in the email.

If this is some sort of accident, I’m hoping moderation can address it.

Very interesting. I will say that the name-based takedowns are doing more good than harm. 99% of items taken down are genuine dominus copies; only a small percentage are not, and I’d hope these ones could be appealed and reinstated.

Out of curiousity; can you appeal these via the Appeals Portal? If so, yes, they’re likely automated. If not, I’d be interseted to see what comes of submitting a counter notice.

No, you cannot appeal them via the Appeal Portal. And I do think that these banwaves are semi-effective but at the same time are being performed incorrectly -

Roblox should if anything be paying attention to how close a creation is when evaluating these decisions, and they should take moderative action with the correct outlets.

Considering roblox and their terrible moderation there could be a chance someone is impersonating them, their moderation seems like the type to overlook that, if not then this is very strange on roblox’s part to take action against copies almost a year later since they got widely accepted.

Just send a counter notice. The fact that items removed for IP infringement are easier to restore than those removed for spam is crazy, but most people are afraid to send a counter notice because they think their physical address will be leaked — but it’s literally Roblox, so you can do it without any worry at all…

As long as you say you’re authorized to upload the item and include the other legal statements, the content gets restored anyway. Roblox’s stance here once again benefits those trying to abuse the system, while users who simply don’t know any better end up having their items removed. :skull_and_crossbones::pray:

Sent a counter-notice for myself too. I can’t believe they are deleting some of my items from April 2024. I don’t really want a strike on any of my accounts for DMCA related reasons because Roblox thought my model was their intellectual property. This is probably automated though.

It takes around 14 days for items to become available again (in this case, Roblox waits 2 weeks to see if Roblox itself will file a lawsuit — if that even makes sense at all :skull_and_crossbones::skull_and_crossbones:), while refunds go out exactly in 7 days. So Roblox should really work on that. A single DMCA strike means losing a month’s worth of revenue for that UGC item, which is a huge cost for most creators.

Hey, whenever you receive a DMCA, you should be able to request to see the takedown notice. Might give you all more info!

I just got takendown my UGC Domino Crowns and they arent stolen mesh i just made them on blender i try appeal but they said i violating Intelectual Propriety and they wont restore my crowns, its kinda sad because i publish these 1 year ago and only today i got this warning for Copyright

Update: I’d just like to say someone has PMed me information regarding the “Roblox” entity that this person is claiming to be, and we’ve found that it’s likely not actually Roblox.

On legal documents they are stated as “Roblox Corporation” instead of “Roblox”, aswell as other details that don’t add up (Roblox has full permission to delete items for spam, so why would they start taking items down through the DMCA system giving them legal liability?)

I’m still trying to figure out all the details but it’s hard to tell if this is legitimate or not, either way they’re messing this whole process up

If this is true, it’s not just a DMCA violation — it’s fraud and identity misrepresentation, both of which are illegal under U.S. law.

Filing takedowns while falsely claiming to represent Roblox Corporation violates 17 U.S. Code § 512(f) (DMCA misrepresentation), and may also constitute criminal identity fraud under 18 U.S. Code § 1028, which carries fines and up to 5 years in prison.

This is a serious federal offense. Roblox has full legal grounds to sue and press charges if someone is impersonating them in DMCA filings.

I can confirm that these are sent directly from the Roblox account and are not false.

Weird. Also seems like this user had a different moderative action taken on their item and it was just taken offsale.

This is a claim submitted with the new, special version of the Rights Manager known as “Claims”–only given out to reputable creators. This allows Roblox to submit DMCA requests on any catalog item to instantly have them taken off-sale (but not deleted), and creators can then go to their Rights Manager page and “counter” the claim if they believe their item was incorrectly moderated, which instantly reinstates it until Roblox reviews the counter claim and decides if they want to challenge it or not.

It’s a confusing system but I’m sure it’s documented somewhere.
