Trouble with commission

My Predicament

So I hired a builder for my game on the terms that he would get 30% of game revenue if he worked on the game at least two times a week, and didn’t use the toolbox. This has since been broken, he rarely works on the game, and I have to delete 90% of the assets he brings into the game because they are toolbox items. I told him I would fire him if he kept it up, but when I said this he said If I didn’t let him take out all of the stuff he made then he would report me for scamming.

My Questions;
Can he do this?
Are the assets he made legally owned by the game?
Can I take away his percentage if I fire him?

Not all of them, there are three that are made by him, although one of them is a bit suspicious. So, the assets that are from the toolbox are not legally owned by the game, which is kinda obvious, but what about the ones that were made by him, can I keep those in the game or do I have to take them out?
