Simple question- are UGC items allowed to be used in-game with or without the creator’s permission?

You would need to get permission from the creator of the said hat, yes. You can use non-UGC hats at no cost, though.

Even though this got a solution there are some existing topics about this already in other category’s that might be helpful consider searching before posting a similar thread these threads have been already been answered and brought up over and over again. From my understanding you’ll need to ask for permission before using any UGC product in your game don’t use any UGC in your game without explicit from the creators.
As for the Roblox community rules state this: section ll 3.) Using Appropriate Content
Community rules
“ Do not upload or use content or materials that you do not own or have permission from the owner to use. If we are notified that your uploaded content violates another’s intellectual property rights, we will block or remove that content without notice and follow the process set out in “
