I have this map, which isn’t public, So I didn’t use it to avoid problems with the original owner if he didn’t want it. I made my map from scratch, It is completely different even to the way it was made (the original map uses parts, and mine uses terrain, which is just one of the numerous differences), but I still used some assets from the original thing, between those are some different houses, and some models to populate the world such as fences, or small rocks to put on roads, if the owner wanted the game down by me using that, would he be able to take it down, with a DMCA or something of sort? It’s also worth including that all those buildings are made using Roblox parts, no external models or anything published by someone, they were all made on Roblox.
So basically, are you asking if someone can successfully take down something you made?
If you’ve used their unreleased assets (houses, fences etc.) then they could come after you for that.

Do you mean that because these were made of Roblox Parts (the common term for Parts, WedgeParts, etc.) you think they are Roblox owned, or do you mean that these were Roblox Models that were used in the original owner’s game?
People throw the word “DMCA” around a lot recently. In short, if he were to DMCA you, he would have to contact you with a notice stating that you have stolen assets and requesting their removal from the game, if you’d fail to go through with this, that’s when your game can be taken down. It must also be mentioned that to claim for DMCA the map has to pretty much be built and based around the original OR has to have property rights inside of the game somewhere. I.e inside of a brick, script etc etc.
Make your game, if he contacts you, remove the assets. If you haven’t copied the majority of the map I can’t imagine the original developer getting mad.
Don’t let the term DMCA rule what you develop and what you don’t - these days it’s an empty threat unless its from a large-scale dev.
No rules on ROBLOX state that you can’t create your experience using references - think about all the remastered games that have been made, would they not have been DMCAed by now?
with that I meant they are models, made entirely out of parts (no published assets) that were sitting around on the original game (idk if that worth mentioning but that game was never even released). But we are not talking about any major stuff, just small fances made out of 4 parts, or igloos made out of 80ish parts, or houses made out of 30 parts… stuff like that that i place around in my map.
