A group has taken our game’s thumbnail, description, and even our title, basically copying everything 1:1.
They recently even added a “Map Update” where they downloaded our Map and just changed the color a bit.
Their game sits at ~500 players currently, and while their game Creation Date is earlier than ours, they have only recently changed their name / description etc. to match ours to probably either get more player engagement or even try to replace us by filing a false DMCA claim.
(I strongly encourage Roblox Moderators to have a look at their / our Experience History, they changed their Name etc. a few days ago while we had ours from release already)
(Screenshot from a few days ago - their game has more players since)
I have made a post a few days ago where I was asking some questions and provided proof (Link - Moderators have taken it down since it was under the wrong category (Development Discussion), but maybe Roblox Moderators etc. can see it, we are linking this and the old post to Roblox too, and we’re posting proof and screenshots under here in a second)
They have had not downloaded our Map at that point of time (You can see how our Map, and theirs looked in comparison in this thread - we are posting Video / Image proof in a second), that happened yesterday.
We’re filing a complaint using the Roblox Support, but I’m not sure if thats enough. Should we use the Rights Manager? Or E-Mail them?
The thing that worries me is giving our personal data to them. I’ve read that in order to file a DMCA request / and or counter-notice you have to give the other party your name and address. Is that true?
I would rather not want to give my or any of our developers private data to people who are involved in malicious behaviour and would probably use that to harm / harrass us shomehow, like explained under this post
Here’s the comparison in thumbnails, you can see how they cut off our image and modified color, text, and some other visual aspects (They cropped part of our image, a section of it is not visible on theirs, also notice how their color of the floor does not even match the rest in the image, and does not match their map - it is pink in their game)
Here u can see how the old maps looked like a couple days ago in comparison (also notice how their ui blocks the Roblox tool hotbar - they didn’t have any slap hands and it was impossible for them to have any, they added them today):
Proof that the character of our thumbnail is in our game, which is not the case for theirs (They might try to rip that asset too soon, though)
The people involved (In higher positions in their group right now - Not sure if this is necessary information, but in case Roblox Moderators / Admins read through our post - I also encourage them to look at our old Devforum post)
You need to provide your full legal name, address, phone number and e-mail in order to file a claim.
If the other party does a counter-notice, the information of that person will be shared with you.
You don’t need to be afraid of that though, the other person who copied your game won’t have access to your information. Only if you’re doing a counter-notice to a DMCA claim then yes, the one who made the DMCA claim will see your info.
You could try Rights Manager, but then again, you need to provide your information in order to use it.
Roblox will obtain your information regardless of how you submit it. If someone disputes your DMCA claim, your information will also be shared with the disputing party, since that’s part of the legal process.
