how do i fix this issue without enabling always on top?

You could make that a particle with a ZIndex of around 1 or you can set the StudOffset Z Position to 1.

If I use a particle emitter, then I get this weird issue, the middle of it is missing.
The billboard gui z offset was a great idea, i didnt realise that there was local space offset
Oh wait a minute, I get this issue now.
