Can I monetize a clothing developers clothing?

Our game is about growing your legs. We want to make a Halloween update that has players search around the map for an item to unlock spider legs, which is this asset.

Our plan is to offer a dev product to locate the next item, so they can get the spider legs sooner. I’ve reached out to the designer of the pants on X and they haven’t responded.

I’m wondering if it’s against TOS to do something like this without the creator’s permission, as we need to publish this update ASAP.

That would be stealing their Asset.
If you have permission to use it or it’s a free model (published by the creator, not stolen and published by someone else!) that would be entirely different.

Is it something they (the creator of the asset) could file a DMCA over?
