Copyright in clothing and DevEx

Hello. I have a clothing group and wondering the rules on copyright?

If I make a shirt with supreme or Adidas logo on it, does that stop me from using Dev Exchange?

If you don’t have permission from the companies to use their trademarks, they have legal grounds to sue you and these penalties are possible if they choose to take action:

  • Damages and lost profits that can be as much as $150,000 per infringement
  • An injunction that will stop the unauthorized use of the copyrighted material
  • Prison time for the infringer (you)
  • Recovery of attorney and court fees that must be paid by the defendant (you)

From copyright.gov:

Serving primarily as an office of record, the Copyright Office is not charged with enforcing the law it administers. Copyright infringement is generally a civil matter, which the copyright owner must pursue in federal court. Under certain circumstances, the infringement may also constitute a criminal misdemeanor or felony, which would be prosecuted by the U.S. Department of Justice.

It’s unlikely that they will take action, but violating copyright is a crime. And if you’re using it to make money (devex) the charges can be worse. But I mean that hasn’t stopped anyone in the past from doing it, those companies are typically just too big to care.

Okay thanks for the reply. So ROBLOX wouldn’t stop me from using DevEx?

I couldn’t tell you for sure, but roblox does respect copyright law and dmca. And knowingly violating them is against terms of service 6.B.5.b and 6.B.5.c and could get your account terminated

Ok thanks, its just so many big clothing groups use these logos and I assume they use DevEx… but if I make the ones with logos ive made as “Not For Sale” will it give me protection with using DevEx do you know?

I’m not sure, roblox doesn’t care enough to enforce their tos and companies are too big to care about someone using their logo. But you never know when that could change for you.

There was a thread about a week ago where Nike or Adidas took down some guy’s entire game down (which wasn’t super popular) because he had used their logo on one of the footballs or jerseys, so I assume that big companies do care about this stuff once it catches their attention.
