Copyright or usable assets?

Alright, so I’ll just be quick.

I’ve been making this Asylum RPG game and we have a really active community. This has resulted in a lot of growth and still rapidly growing community.

I’ve some assets, such as benches which apparently looked the same as another game’s benches. Now I have some people angry, calling “stolen assets” and not quite sure if this could potentially harm the group and game.

I have these benches made from scratch but they look somewhat similar to his, this is what he says is an infringement. I just wanted to ask for your guys opinion on this as I’m still a new developer and find this confusing.
He says that it will be terminated, all the developer’ accounts, group and game will be terminated because the bench looks alike?

Would it be necessary for me to remove it?

It would be good if you would provide the pictures of the models so we can compare.

As far as I know, account termination is very unlikely to happen, but your game might get closed until you fix the issue.

As long as it’s not exactly the same, it’s not stolen asset. Although from what I see, it’s pretty much the same with just color changed.

Pretty sure it isn’t the same length too, as it is NOT a stolen asset, most likely to have differences when it comes to size and space between whatever, but he says it doesn’t matter as long as it looks the same.

They are not the exact same model from what I know here. Shape may be identical. It is definitely not stolen, if you’ve never seen them before.

Also they are very simple to replicate, so I don’t know whether it is copyrightable.

If that’s the case, it’s probably fine.
Creativity isn’t bound by other people’s works, and in case like this, where the design is pretty easy to make, it shoudn’t be considered stolen work.

From the images, they appear to be different. So you should be fine. But you never even saw his benches before you made yours…So how could you have stolen them?

If you still worried about it, you could change the design up slightly like this:

Oh, that was a really good idea. Thank you for that.

Ultimately, nothing will happen if you don’t change it anyway. If you have actually made it yourself, it is such a common bench design in the real world anyway so nothing would happen. Sounds like they are just trying to scare you.

Sizing is different(?). I wouldn’t worry too much about the threats. Roblox investigates DMCA claims and it’s up to them to decide. If things escalate, you should just cut yourself the loss and make a new one.

Hm. I just don’t feel comfortable not being able to use basic bench designs without the possibility of all the work to be temporarily or forever shut down because of a single asset that looked alike. It’s like these things are making it more difficult to make assets for your game.

I’ve seen a lot of games who uses this kind of table as well (like SCP, prison, or horror type games), so there isn’t much to worry about.

That is an incredibly common design for a bench, and is definitely not copyright-able, don’t worry about it.

The developer who is sending you comments saying you and your groups, accounts, and game will be terminated is making stuff up - if he sent these messages over any Roblox platform, I would report them.

They’re definitely not the same. Your tables is shorter and has thicker seats while the other game has longer tables and thinner seats. The stumps on the bottom are different too, yours are rectangle while the other game has square ones. The colours are different too.

You don’t need to worry about anything. It’s obvious you’ve built yours and not exploited though they do have the same design.

The worst you’ll get is some comments saying you’ve copied and a couple of dislikes which won’t amount to much.

I can’t help but laugh.
It’s a picnic table that can be seen all over.
It is a simple enough design that a part count being equal is easily expected.

Tell 10 people to make a simple chair, 8 of them having 6 parts would be expected.

@gothiu just delete the little feet at the bottom, and you have your same table with 4 less parts :stuck_out_tongue:

It’s very poor tact to accuse others of stealing a very simplistic design. 17 Instances is hardly something worth getting worked up over, and to be frank isn’t even worth stealing. I’ve seen designs similar to this countless times in the past and I honestly wouldn’t be surprised if this same exact design was released as a FM far before either party got a hold of it.
