Could a brand name combined with other words risk a DMCA strike?

Hiya, recently I have wanted to make a group which includes a popular brand name called ‘Dior’ but it wouldn’t stand alone as ‘Dior’, it would stand as ‘Dior Spirits’. I’m just afraid that If I include the brand’s name I will be hit with a DMCA strike.

Would the group be taken down?

In my opinion, I think it will get taken down because there someone that I heard about who created a group with the name of Starbucks he got DMCA so hard that they locked his group completely so I suggest you to make it your own unique way and try your best to avoid the copy strike :slight_smile:

It probably won’t get taken down but I’m not sure if its a risk worth taking.
Theres literally 10s of groups named “gucci” sometimes with 1k+ members and they haven’t been taken down.

I guess but it really depends on if a company actually notices it or gets a report about it.

I’m not a lawyer, however as I’ve dabbled in the music industry a lot, I can safely say (in my opinion) that this wouldn’t be copyright enforced, as;

  1. Brand names are trademarks, not copyrighted works.
  2. Trademarks only apply to the direct use within the industry of the trademark holder.
  3. The name “Dior Spirits” isn’t their trademark, as you have created that name, hence them having no claim to it.

As long as you make your logo significantly different from the two brands, you should be fine.
