DMCA Exploit / Counter Notice Auto Reject

When I try to submit a counter notice for 2 false DMCA strikes on my account, Roblox support agents automatically decline my request.

To be clear, the bug (I think) is that Roblox has a format policy way too strict for a counter notice, Roblox support seems to automatically reject me without explaining the issue, and there are way too many people who abuse the easy-to-use rights manager to falsely take items down through exploits.

The second bug (I know) is people using exploits to falsely submit DMCA claims. How they do this is have a old Roblox model on the creator marketplace and then they publish new assets using the “Replace existing model” feature when publishing. This replaces the old model while keeping the creation date. When they use the rights manager and claim it is theirs, Roblox assumes they are correct purely based off the fact that theirs was created before the one they report despite it being replaced/edited.

It is very unfair to victims as not only is it really easy to target others, it is very difficult to submit a counter notice.

Please point out any issues with my counter notice and fix the DMCA exploit.

I’m 99% sure this was patched ages ago after people started exploiting it to the extreme. They check the last updated date rather than the creation date now, from what I know.

Ok that’s good. I just have 2 false DMCA claims on my account and can’t seem to get the counter notice to be accepted. I was once terminated but by some miracle Roblox support removed a strike when I explained the situation. They wouldn’t remove the other two no matter what I did so I gave up but I realized one strike on my account means termination so I am trying to get these two removed.

The agent who replied to you is correct. You haven’t met the requirement in their second point, so it doesn’t count as a proper counter-notice.

Also, the screenshot in the part where you said “I then replied with” is the same screenshot that contains the agent’s reply from the one you shared above.

How did I not meet the second requirement? Can you give an example of what a statement under penalty of perjury looks like?

I would strongly discourage you from seeking legal advice here.

I don’t have the funds to afford a lawyer for 2 roblox ugc items and I have seeked legal advice from other parts of the internet but it seems roblox doesn’t accept that. I’m sure however that other creators have successfully submitted counter notices so it would be great to get advice from them.
