To my information, they tried to archive & delete their items before being banned, however the moderation did not account that & they didn’t remove the items so my friends still got banned anyways.
The email mentioned they will NOT be banned.
Email template they received:
Then they striked down another item in a group (as I said I dupe uploaded by accident, so basically same texture/mesh item) but that time, it gave me a strike and banned me for 3 days.
Accepting claims doesn’t give you a warning or a ban, nor is anything done to your account and removes the item from the platform.
Why can’t Roblox just turn our bans into claims? Higher ups need to see this.
I’m sure that NO ONE is going to reject a claim from Roblox themselves and risk a ban on their own platform.
I never even received a claim, just straight up strikes, the way they have gone about the removal of assets is seemingly illegal iirc because they’re mass deleting under dmca not even their normal content removal, dmca claims are intended to be sent with good faith, an ai cannot request a removal under good faith. Roblox has become increasingly shameless and disrespectful towards their creators. I suggest you use a different route other than just the copyright agent to reinstate your account to good standing if you are facing strikes, pretty sad and pathetic we have to use outward sources to apply pressure to Roblox but this is the state of this platform now.
Luckily I’m a resident of the EU so I can use a third party to appeal a moderation. I hope that ADROIT will help me, since I’ve heard people got unterminated due to it.
I am in the US, so I will be filing MIDR and contacting the US copyright office , god speed to you and your endeavors. The valk ban wave has been completely executed I believe.
First strike was caused by one big company and I have nothing to tell abt it. Second strike was awful, because it was caused by roblox, you can read abt it in my post (Unfair DMCA ban). So I have 1 strike left to get terminated, but, just in case I requested deletion of 500+ items and everytime I get ban, I can appeal trough support by telling them this text:
Hello, Im Noobhackbros, and my account got terminated due IP violation (Asset ID: UR ITEM ID).
I want to tell you that I requested deletion of this assets in ticket (UR DELETION REQUEST TICKET NUMBER) and they said: “No strike or moderation action should be applied to your account as a result of this request. If you receive a strike or moderation action, please reply to this email and we will assist you further.”
And you need to pin PDF copy of ticket as reply to email.
I’d like to mention that the DMCA strike system seems to have degraded over the past few years. When it was introduced around 2019, there was clear language on what strike you were on, and how to enlist on the remediation program. It also clarified that you had a 45 day period before you could get a 2nd strike, giving you time to archive stuff. If you were also in the remediation program, they would consider that before giving you another strike.
(devforum post about the 45 day grace period between strikes)
Nowadays, the remediation program is discontinued, there is no language on which strike you are on, and there is seemingly no grace period any longer, being able to be termed instantly over 3 DMCAs. Examples include Korblox_Guardian who was instantly termed over 3+ false DMCAs by Roblox, and 0rcl in this thread who was assigned 2 strikes in a single day, again over false DMCAs by Roblox. Do note that you cannot in any way counter or dispute a DMCA by Roblox, copyright agents ignore you. I’ve also seen cases where people were terminated on their first strike.
I also noticed that support now refuses to take archive requests to archive UGC items, instead forcing you to wait 6 months to archive it yourself. If you get a DMCA strike on an asset you wanted to archive, but couldnt since you had to wait 6 months, there is no longer a way to get it removed by telling support you requested it be taken down in good faith.
Also worth to mention, the archive section in the creation docs does mention that Roblox will “consider” applying a penalty if the item was archived. In the case the item was archived by yourself, and you get a strike, how would it be possible to remove? Can Support see if it was archived? I don’t know yet.
Just noticed, Roblox says in this devforum post that you won’t be given strikes on assets you’ve requested to archive. Despite this, you do indeed get strikes on these assets, and have to send a ticket to support to try and get it removed. Do note that I’ve seen cases where the agents refuse to remove the strike despite the person sending an archival request, sometimes by saying that no such archival request exists, or something else they make up.
Don’t think you can archive bundles like that though.
I’m requesting archival for ONE valkyrie helmet that was missed during the “banwave” even though it has the same mesh as others THAT GOT STRIKED DOWN BY ROBLOX, so why leave this one?
And plus those valkyries weren’t supposed to be striked in the first place as they are derivative work and do NOT look the same AT ALL. I’ll comply with Roblox, though, sure, take down my valkyries I don’t mind BUT DON’T leave a strike on my account and terminate me falsely.
I think that we need to get ready for another ban wave 30-31 Aug, because last time roblox tested their DMCA bot was on weekends, probably when mods are chilling
