Issue with DMCA Counter-Notification by a Minor and Inadequate Review by Roblox Support

Hi everyone,

I’m dealing with a legal issue on Roblox involving a DMCA counter-notification submitted by a minor. The situation has become quite complicated, and I’d like to share my experience to see if anyone else has faced something similar or can offer some guidance.

Background:

Some time ago, I received a DMCA counter-notification from a user on Roblox. According to their official identification, the user is a 17-year-old minor. As most people know, minors cannot legally sign documents like counter-notifications without the express consent of a legal guardian or representative.

I notified Roblox support of this fact in my response to the counter-notification. However, it seems that support didn’t read or review my message properly, as they sent me a standard response asking me to provide a court order to stop the alleged infringing activities by the counter-notifier—something that clearly doesn’t make sense in this case, since the counter-notifier is a minor.

My Response:

I reiterated in my response that the counter-notification is invalid since it was signed by a minor without legal guardian involvement. I also clarified that I do not intend to take further legal action against a minor, as it’s not appropriate or feasible in this situation. Despite this, the support response was the same: they urged me to obtain a court order, completely ignoring the fact that the counter-notifier is a minor.

Issues with Support:

It seems that the support agent handling my case is not paying attention to the key details. I have tried escalating the issue and asking for a proper review, but I still haven’t received a response that addresses the fact that a minor cannot sign this type of document.

I’m considering reporting the agent for not handling the case correctly, as this situation has caused a lot of frustration. Additionally, Roblox is insisting that without a court order, they will reinstate the infringing content, which I believe is a major mistake given that the counter-notification is invalid.

My Question to the Community:

Has anyone else experienced something similar with DMCA counter-notifications on Roblox or dealt with a minor being involved in such a situation? Any advice on how to handle this effectively or how to get Roblox support to properly address the key details of the case? I would really appreciate any insights or experiences you can share.
