Laws on someone else's builds in a game

If I put someone else’s builds in my game and credit the builder with their name (ingame on sign) but with out permission from them, am I able to put them them in the game. This game would probably make Robux if that changes anything.

And I would not change the models at all

I’m not a builder nor a modeller, but I know for a fact that it’s absolutely disgusting to take someone’s hard work without their consent. What’s even worse is making profits out of the theft (Robux). Seriously, you don’t have anything to lose by asking them. If they say yes, good for you! If they say no, then don’t do it. Imagine playing a pretty popular game on Roblox and suddenly you see your builds. Even though there may be a sign with your name, it doesn’t mean they can use it. That’s not how credits work!

You stole the assets tho, which is still illegal. Don’t even call yourself a Builder if this is the way you make games. Not to be rude, but man do you seriously think it’s alright? I’m not going to respond anymore.

If you directly steal assets OR use stolen assets from the toolbox, you are breaking the rules.

in my opinion, if its in the free models then go for it. If a creator does not want their builds being used in somebody elses game then dont make it free to use.

The owners of the ones in the tool box are not Haz3mn’s. I wan to get cleared first becasue if My game goes crazy without his permission the I will get Soud

Since the assets are in the toolbox, check who uploaded them. If the original owner of the asset is the publisher then you are free to use the assets in your game as this is considered implied consent under the law.

If however the assets are not published by the original owner, avoid them as they were likely stolen.

This “I found it in the toolbox so it should be okay to use” mentality is not good thinking at all.

Just because you find another creators assets in the toolbox, doesn’t mean they’re 100% okay to use. It is very likely that the other user is infringing upon their creator rights, and SaveInstanced their assets.

I would recommend learning to build your own models, so you can replicate what the other creator made in your own style. Roblox said it in a recent announcement, that the way copyright works on this platform is by the uniqueness of the asset. If you just blatantly copy it, you’re in for some big trouble.

Background check the assets you use from the toolbox if you absolutely need to use a toolbox item. Otherwise, don’t use toolbox assets in any commercial form, it can be dangerous considering the topic of this post.

There are tutorials on YouTube that can help, or you can find other builds in the toolbox that you can learn to create your own building style from.

So overall, when something is posted in the toolbox the Uploader (dosnt matter if they actually owns the asset) grants roblox a royalty free distribution license. So because the one distributing the assets in the toolbox is actually Roblox trough that license i mentioned, other people can use those assets without infringing any rights of the original creator.

Yet. if the Uploader does not have copyright ownership of the asset that makes them liable to copyright theft as by uploading they claim that the asset is owned by them or they have the right to grant a royalty free distribution license on behalf of the creator.

So if you are wondering if you will get directly in trouble for using something from the toolbox knowing its been stolen the direct answer is - No, you wont get in trouble. The uploader will get in alot of trouble as once they upload something to the toolbox it will go in the active search only if they were verified, meaning that once a copyright claim is filed Roblox can file a lawsuit to the actual person (because they were verified roblox has their personal info) which will require the Uploader to reimburse any profits made from their upload, including your game if you use that asset.

It will probably end up in that asset being removed from your game automatically once the uploader has been banned and roblox will calculate the profits from your game and add them as money that the Uploader must pay.

Yet if they have a strong lawyer i can say that a settlement can be made as roblox has a couple of flaws in their system that they know about which are not fixed and situations like this can occur.

Apart from that you will be banned from PLS donate as their builder does not like their assets to be reused even in good faith and is actively fighting copyright infringements
