Music Copyright Consequences

What will happen if I use music that could be copyrighted?


Alright so I was just wondering if I would get any kind of heads up like “Hey so someone made a copyright strike on your game, so I gotta ask you to remove it” or if it just instantly starts punishing you.


tl;dr:

If you use copyrighted music will Roblox either:

  1. Punish you.

  2. Tell you to remove the copyrighted music and then if you don’t within a certain amount of time THEN punish you.


Reason why I ask:

I’ve been listening to this song from Rockstar Game’s Red Dead Redemption 2, “That’s the way it is”

I’ve been listening to this AMAZING cover:

So since he’s using the song, or at least the name, I’m assuming it’s okay for me to use it. But I don’t know for sure.

So by putting this in my game, what will happen if it turns out to be copyright? Will it just be removed? Will I get a warning? Will I be punished as well as the uploader?

I think you will get a warning, and the sound will be removed or maybe not approved in the first place :grinning:

In my experience I have found multiple covers of popular songs that have not gotten taken down, so from that I would say that it is alright. Other than that I would read up on the TOS, specifically the section relating to that.

Just because it doesn’t get taken down doesn’t mean it isn’t copyright infringement. If you upload ANYTHING, even a cover or remix, without the creator’s permission, you are breaking the law and risk having moderation action taken against your account.

The only time you can legally upload something you did not create is if you have permission or it is in the public domain.

I haven’t uploaded any audios before. I was saying that I have found covers that weren’t automatically taken down. In those instances that I have found the cover could have had the creators permission, and that is why they were still up. Popular songs automatically get taken down though, and these ones didn’t, so I was just pointing that out.

When uploading audios, if Roblox detects it to be copyrighted during the uploading process, it’ll refund the upload fee and reject the audio with a message on the audio’s webpage saying the audio was removed for copyright.

If you manage to bypass this copyright detection, and if it is reported to Roblox, it’ll get taken down, and you’ll likely be notified, but this has never happened to me so I do not know if you get a warning or other moderation etc.

In my opinion, it is highly unlikely that Roblox will ask you to take down your audio, when they can easily take it down themselves, and it may even be legislation that they take it down immediately on request by the copyright owners.

To summarise, Roblox check for copyrighted content when uploading, and they will reject it during upload if they find it to violate copyright. In regards to your question, it’s option 1, but whether or not you get moderation action on your account is a matter I cannot answer, as it hasn’t happened to me.

I changed the scenario, made an edit for it.

I was wondering if I use audio that’s already uploaded, a cover, then what will happen to me and my game if they/we get a copyright takedown if it’s copyright?

Copyright law can be confusing. Just because the person who made the cover had permission does not mean you have permission to upload that cover elsewhere. You need to get permission from the person who made the cover if you want to be in good standing with the law. :slight_smile:

Assuming you didn’t upload it, the audio will just become jazz music.

Okay, so no assumptions or anything, just a clear-cut answer, if I did this, in this order:

  1. Went into the Create tab on the Roblox website.
  2. Got a song.
  3. Put the song in my game.

Then what exactly will happen to me and my game not accounting for anything, or anyone else. No law, no other users, no Rockstar games,

just me, and my game.

Nothing will happen. The audio will just turn into jazz music. It’s happened to me a lot.
