My game is taken down due to trademark despite most of the assets is self made and taken from free library

First off, if this thread is placed in the wrong subforum. Then im sorry, and do tell me where the appropriate place to put this thread. In any case, i feels like asking the devforum is better for this since hopefully, the community can relate or more knowledgable about this issue.

To the issues, just recently, (yesterday) my game is taken down due to (allegedly) trademark. But the issue is, the game assets is 95% my own assets, only the rest 5% is some audio and decal taken from roblox free library, in which as far as i know, 100% definitely is legal to use.

I have sent an email requesting for review and unban the game, or atleast some direction and if its actually true, what assets is violating the trademark. But knowing the history of roblox support and the fact im just some unknown roblox developer. I have some doubt the email is going to work. At the positive side, atleast the game file and data is still intact in studio and i can still access everything in there. Its just not accessible in the web now.

Should i just ignore this and reupload the game (thus resetting all statistic the and link the game has earned. The game is sponsored in surreal game finder)? If there’s no help to this, i might just quit roblox developing altogether.

Can you explain what the asset was that got moderated or what the game was about?

You can use assets from the Roblox library but keep in mind these are uploaded by random people, and many of these assets are not legitimate, which mean the users that uploaded them are often not the original creators, so these assets can be copyrighted.

Free models aren’t usually to be trusted unless they’re published by known creators or the model has a good reputation. (no offense to smaller creators who publish but this is how I view stuff if I ever chose to use a free model)

Yeah, that’s pretty much why I reccommend to never use assets that come from the Roblox library, and only use online assets that are under a Creative Common License that we can find on trusted websites instead, such as sketchfab for 3D models for exemple.

Which is valid because there’s many dodgy things in the library.

Well this sounds very weird, If you believe the takedown was a mistake, you can file a DMCA counter-notice with Roblox, this process allows you to contest the removal if you have a good faith belief that your content was wrongly taken down

Keep in mind that submitting a counter notice requires providing the original claimant with the opportunity to pursue legal action

The game is just a platformer exploration combat with studs theme, nothing innapropriate.

The assets i take from library is some visual art decal like for trash can, flop disk icon, exit icon, and some minor stuff.

As for the audio, i take a glass breaking sound and free model explosion sound, which is owned by roblox itself. Also some glitch.

As for now, you’re right, maybe i should remove all non-owned sounds and decal and replace that assets with nonsense placeholder image

I recommend you do so feel free to message me if you need any support I can’t do much however since I don’t use Roblox or studio anymore because I’ve gotten terminated I’m working with support on getting it back.

How do i write a DMCA counter-notice. Not experienced in this field, so i have no idea how to write one and in what format. Im currently researching right now, but it would be nice if you could provide the guidance on how to, especially on roblox case. The DMCA forum roblox provide isnt really informative on how to write counter-notice except that i could get in legal action if its was false.

But, reading the previous reply. I have lost faith in roblox toolbox and planning to remove everything i have used from toolbox. Since Roblox isnt being descriptive on what content infrige the IP violation. Say that i have removed the infringing content. How do i ask Roblox that i have removed the violated content and to reinstate my game?

Just send them normally, you’re making it seem more complicated than it actually is

Im sorry if you find my request “more complicated than it actually is” (No offense). Its just that i have barebone experience in writing formal mail and finding the right word for formal situation, especially since english is not my native languale. But regardless, thanks for giving me example of DMCA counter-notice.

I meant that you’re making it seem complicated even though it isn’t and yeah, I do understand what you’re saying. Anyway, I’d suggest you put more information regarding your game and not just send that right away

Further information : Yesterday, i have sent a counter-email informing that i have removed potentially-violating assets (Every assets i took from toolbox is removed, since i don’t know which assets is violating). Today, Roblox support sent me a reply email noticing this :

Now this raise more question to me. But before that, it will be better if i give more context about what my game about and possibilities reason for the claim of copyright from LEGO.

As you can see, my game heavily consist of studs theme, built-in from Roblox itself, which is probably where the similiarity to LEGO claim is, while however LEGO is not my intent to copy, my base inspiration is roblox classic game like Crossroads and High cliff.

Granted, some of the decal is Roblox Studs i screenshotted and editted so i can incorporate studs style into the game Gui. This could be another reason but i doubt.

So i have several questions regarding this :
1 - Is making studs game no longer allowed in Roblox, due to copyrighting LEGO? As far as i know, this couldn’t be the case, since some games still using Studs as their texture.
2 - Is taking Roblox Studs texture (Studs, inlet, weld) by mean of screenshot or taking it from internet, editing it, and use it for Roblox game use (Like for decal, texture, or Gui, since you can’t apply roblox built-in surface texture there) not allowed and infringe copyright?

In the meantime. I have sent another reply to the email, mentioning that this could be all misunderstanding and in no way i intent to violate LEGO copyright. Hopefully this could be resolved without me having to remove all studs texture.
