Questions about DMCA

I had a few questions about DMCA’ing a game. Currently I’ve been using the Rights Manager to take down stolen copies of my assets (3D Modeled School Buses). However it doesn’t seem to work as good when you’re reporting experiences that are currently using them aswell.

The game I’m attempting to DMCA is based around the category of “School Bus Simulator” where you drive the school buses around a map. Their map is partly original to them but the buses are the star of the game. The buses they’re currently using are mine and the owner refuses to remove them.

I never uploaded my version of the bus models until May of this year because I found out about the Rights Manager. I still have trouble reporting stolen copies on the marketplace yes, but some copyright agents take my side sometimes.

As I said, the experience has an original map to themselves, but the buses they’re using are my intellectual property. There is nothing else inside the game except the map, and the buses. No cars, nothing else.

I’ve already attempted to DMCA them once but the agent rejected it for this:

Thank you for your patience. After reviewing your report we are unable to take further action on the reported content because it is unclear that the reported content infringes your intellectual property rights. Specifically, your original work does not appear to be sufficiently creative to qualify for robust copyright protection and it is not clear that the reported content has actually used your original work.

Meanwhile, I gave them all the necessary information. Images of the bus being used in the experience, proof of the meshes on the bus being mine, and even links to our website where we’ve listed the bus as property of (I’m not sure if I’m allowed to say the company name so I wont).

So in short the questions are:

  • What should I do about that outcome?
  • Is my reasoning for filing DMCA good enough?
  • Is there anything I should do before filing again?

    This is one of the buses I was filing DMCA for. This is our stock file for this specific bus.

I probably wouldn’t have tried to inform them they you were going to DMCA them. They could have possibly modified your asset and complicated the whole takedown process.

You can email to copyright_agent@roblox.com to see if that gets you anywhere, should the Rights Manager still not work for you.


This is an example of what the people who use the buses do with them, they mostly just recolor the bus and add small parts to it. It doesn’t seem too different enough that its impossible to DMCA.
