I want to use some weapons and sounds from the game ‘Halo’ but I’m not sure if it would be considered copyright or not.
I currenty use firing sounds from Halo for all my weapons and basing all weapons off of the weapons from the game.

Of course it would. Microsoft didn’t make the weapon models public domain.
What if it was made by someone else? I got the model off of TurboSquid.
Is it a recreation build or the 3D model ripped from the game?
Additionally, if the sounds are ripped from the game, that infringes copyright no matter who uploaded it (unless they’re royalty free sounds, which you may have to look into).
What Kano is trying to explain is that, even if you got it off a site, it’s still Microsoft’s asset and not for the taking. The answer to your question is “no”.
It’s Microsoft’s asset if it was ripped, otherwise probably not. But you need to check all the assets.
But a more serious question is, why do you want Halo assets? Are you creating a Halo-themed game? If so, that may be a bigger issue than just using weapons. If you are trying to mimic the types of vehicles, enemies, etc then you should be prepared for a takedown.
Using actual Halo assets is not safe and against the terms of service if you don’t have permission from the developers to use those assets.
Using the name “Halo” or other names from the series is also not safe and against the terms of service for the same reasons.
Using assets that are not exactly the assets from halo, but still inspired off of Halo may not be safe either if the game you are making is similar enough to the style and design of Halo games.
Creating a game just for the purpose of simulating a Halo game is not a good idea for those reasons. You should make original games instead. Using third party IP is strictly against the terms of service if you don’t have permission from the copyright owner, and will result in takedown if the copyright owner finds out and informs Roblox.
Good rule of thumb: Don’t use anything unless it explicitly says you can, or you purchased it under a license that allows you to use it in such a way.
Installation 01 exists by following Microsoft’s game content usage rules: Game Content Usage Rules | Xbox
Ripping game assets isn’t allowed but you can make derivatives of their work, basically re-create it as long as it is noncommercial.
I would make your helmets and weapons out of unions and not meshes. And use similar sounds if you want to try to recreate it. But don’t use the name “Halo”. It’ll probably get taken down like all the Pokemon games.
Be careful what you say - common misconception is that you are allowed to use copyrighted or trademarked IP so long as you don’t make money from it, either on Roblox or in the real world. But that’s not the case. Unless you have a deal with the company or the make it crystal clear you are allowed to use their IP, steer clear of it.
Read the link provided. Microsoft explicitly states what sparker22 is referring to. It is a common misconception yes but in this case it’s applicable.
I understood that he got that from the link. I was trying to point out to anyone else reading that you can’t use that principle on everything. I suppose I could have addressed and worded it better.
