What are the rules regarding DMCA

I’m running out of ideas on what game I could make, and I’ve seen a few I would like to recreate & improve. However, I fear that my account may get deleted, and the copyright rules aren’t clear to me. Can someone explain what is :ok_hand: to do? (Not making an exact replica, but the same theme, idea etc)

TL;DR: If you make content that violates someone else’s intellectual property/copyright, Roblox has 0 control over what happens, and you may have to settle it with them in court. If you receive 3 DMCA takedowns that you don’t appeal with a counter notice, your account will be terminated.

Roblox has very little control over DMCA. The way DMCA works is as follows:

  • Someone who owns the intellectual property sees something that they think violates their copyright
  • They submit a DMCA takedown notice to Roblox
  • Roblox is now required by law to take down the game/content, no questions asked, and Roblox can do absolutely nothing about it.

Now, if the takedown notice is false, you must submit a counter notice, which works as follows:

  • You must send a counter notice to Roblox (which gets forwarded to the person who filed the DMCA takedown notice) which contains your: name, address, and telephone number.
  • The person who filed the counter notice now has a short amount of time to file a lawsuit against you, if they do so then your game/content will remain closed until the lawsuit is settled. If they do not file a lawsuit, then your game/content will be reopened/readded.

Roblox has 0 control over what happens here. If you think something infringes on someone else’s copyright/intellectual property, then don’t make it. If you receive 3 DMCA takedowns that you don’t appeal with a counter notice, your account will be terminated.
