When showing the public of an art piece you made, it’s always good to add a watermark to it so if someone does end up trying to claim it as their own, your name would be on it and they would have a hard time trying to hide your name if placed correctly. I would suggest adding watermarks to your work, and if someone is buying from you, then put a watermark over the entire image so they don’t steal it without paying.
I make digital art and this is just what I do, I hope it helps your issue as well!
I’m really sorry someone is stealing your work. I’ve never dealt with this kind of issue before so I’m not as great as giving advice, but since they stole your art and it has your name on it, anyone who sees it would go to you rather than them. They can only go so far when stealing someone’s art because it’s not rightfully theirs.
I really do hope this never happens again and I wish you the best.
In future, I would watermark your content as best you can, and match it exactly with your username. No one can say “You aren’t the real iiForcedLaw!” without looking like a bit of a numpty.
I tend to be a bit overzealous (though maybe rightly so) with my watermarking. I cover the entire image with low-opacity watermarks until such a time that I am paid; after that point, how they use the art is really up to them.
If the entire image is watermarked like this, then using the whole image isn’t really practical for them, and using any small cropped part of the image is also difficult. It will, if stolen, have my name on it. Or at least look odd.
Want results? Tbh Roblox support doesn’t help I’ve tried before. Get a copyright and copy right claim them and then see if you can get some of their earnings because they’re using your work without permission. But copy right isn’t cheap but it’s worth it long term.
Best option, if they aren’t co-operating is to send a DMCA takedown notice. Please read Roblox’s Terms of Service on DMCA, they tell you exactly what they require in the request!
Roblox is legally obligated to respond to takedown notices immediately (else they loose their safe harbor).
You do not need to apply for a copyright, you have the right to copy your own material the instant you make a creative work.
You can register your copyright (see your country specific laws) to legally prove you own a copyright. This is not required, though is beneficial, if you want to sue (not legal advice, speak to a real lawyer).
I did this, but Roblox just told me “they can’t help me”. Absolutely crazy! Link to the copied thumbnail: Guess The Flag - Roblox (You can literally see my watermark)
