Will I get banned/ game gets taken down for including this audio in my game?

I wanted to use the song “panorama” by fishisuso in my game, and was wondering if it was going to get taken down or not. Sol’s rng uses the same song for the “chromatic” aura theme, and their game didn’t get taken down.

(Also, here is a screenshot of what the creator of the song said about using the song to the creator of Sol’s RNG.)

You should be fine, but if for any reason the creator wants it removed it’ll probably be removed. You should also ask the creator yourself if you can use it.
