Will my game get copyrighted?

Hello everyone, I’m sort of a new developer and I’m currently making my first game which is a class fighting game that is inspired by critical strike, but the twist is that: Instead of battling for kills, you have to paint the map as much as possible. Which is probably fine to do, except that it is awfully similar to Splatoon, a game made by Nintendo, and when I heard Nintendo, I had flashbacks of Pokemon Brick Bronze being taken down.

So my question is: Will my game get copyrighted because we had the same concept/idea for a game? Of course I’ll be creating my own classes, leveling system, equipments and so on but I just wanted to ask this so that I can discontinue it before making too much progress.

I think They Might do it if your games gets too popular But chances are like 5-9% that they will do something like that.

The reason why Brick Bronze was taken down was because of the reliance on the “Pokemon” name and assets-- not necessarily the gameplay.

If you make a turf-based paintball game without using any Splatoon resources, art, sound or character concepts, you’ll be fine.

According to copyright.gov, copyright does not extend to ideas in themselves.

Safe to say you’ll be fine, so long as you aren’t using other IP without explicit permission from the IP holder.

Just make sure to use original names the only reason brick bronze was taken down is because it used copyrighted names I dont think Nintendo can do anything but if your game gets on the top page it will probably get taken down to satisfy Nintendo

Doesn’t really matter if Nintendo gets mad roblox would just take down the game to satisfy them

Nintendo wouldn’t have a case. They don’t own copyright over turf-based paint games.

Whether Roblox would fulfill the DMCA request is a different story.

I mean there was a lot off things with brick bronze it used pictures of the Pokemon’s of the original game it had the same exact story line it wasn’t just the name “Pokemon”

Games get taken down because of the use of other games’ assets without legal permission. If you aren’t copying an asset from the Nintendo game, you’ll be fine. The reason PBB was taken down was because of the assets such as the sprites and including their brand name when they had no affiliation. You’ll be fine, don’t worry too much about inspiration getting taken down :slight_smile:

They done it multiple times in the past and they were almost willing to take down the roblox fall guys game group, but the only reason the fall guys thing stayed up is because of how popular it was

You should be okay. Just because you have a Concept similar to another game won’t get yours taken down. Just don’t take any material from Critical Strike like music, assets, ect.

Will do. I just enjoyed playing Critical Strike and thought I wanted to make a game inspired by it, with a different idea of course. :slightly_smiling_face:

Roblox does not delete games if there is insufficient documentation provided and companies aren’t as trigger happy as that in issuing unfaithful DMCA takedown requests. Furthermore, you are given the option to counter claims if you have sufficient documentation declaring your permission to use assets or that you are not infringing copyright.

Ideas can’t be copyrighted, but the execution of them can be. If your execution is infringing on another’s copyright, they are fully within their right to issue a takedown on your works. This is what led to the takedown of the games you listed as examples: Pokemon Brick Bronze, DropBlox and SlipBlox (the latter two being Fall Guys games).

Popularity has nothing to do with any factor here, these are legal dealings. The games were taken down and were or are forced to make changes if they wish to avoid copyright protection action or otherwise.

I’m sorry I didn’t know this, also I didn’t say mean to say copyrighted I meant deleted, thanks for telling me. Also if my solution wasn’t good you should probably tell him.

A game concept cannot be copyrighted, as long as you use your own assets, logos, names, etc. you should be fine.
