Character roster question regarding celebrities

With virtual concerts underway, the question arises, am I able to add celebrities who’ve been of the Roblox Platform and who’ve performed or are performing into a character roster for a game?

I would assume yes just because you can use their characters in your game, as well as reference them. But another question arises, will I get DMCA’ed for using and referencing them?

If someone could help me out on this one, I’d greatly appreciate it as I’m planning to add them later on in the roster, but I just need to know if I can, and if I can, do I need to get special permission.

This question also goes with the virtual items that are given out during these events, am I able to use those too? Without being DMCA’ed too?

What’s your definition of a “roster?”

I’m not a legal expert, but I don’t think you would be allowed to “represent” a celebrity through gameplay. Most if not all these Roblox events that feature celebrities are under contract and have strict terms and agreements that both parties have to adhere to. However, this varies on what you plan on doing with said character.

A character roster is a list of available characters that can be used in a game.

That’s one of the things that I was thinking about as it could be way harder to gain permission.

I suppose there’s nothing wrong with you taking their outfit and incorporating it into your game. Just try to avoid using their name. Again, not a legal expert and this could be 100% wrong.

I was planning to reference them somehow. For instance, LilNasX would have the character reference of “ a cowboy from an old country road” or something along those lines.

Answered this yesterday. Roblox partnering with an entity does not grant you the right to use content from that entity, up to and including anything that Roblox uploads as part of that collaboration.

Use custom characters and find different items to use.
