Recently I have sent a DMCA notice to a group known as “Malevolent Creations” Their Group Which have also stolen numerous other assets from various creators. This group reuploaded one of my UGC which was very clearly a rip of my mesh and texture. However, ever since today I have received a Counter DMCA which states if I don’t respond or do anything about it they will reinstate their item within 10 business days. On this Counter I believe they put false information on it and I don’t know how Roblox even accepted the counter because the stolen item is an exact 1:1 of my original hat.
Expected behavior
I expect Counters to be looked into with more detail then to just be pushed out when its very clear that the infringing content uses my asset(s) and or other creators asset(s) if they decide to DMCA.
Roblox can’t do anything about this, especially the staff on the engineering side, as this is a legal process. You should resolve the issue among yourselves instead of sending bug reports. If they believe their content was falsely DMCA’d, they have the right to send a counter notice.
It is impossible to resolve the issue among them as they have provided false info on the counter and It is too expensive to hire a lawyer. Using bug reports I feel like brings this attention to Roblox since they’ll typically do nothing against these groups who steal. But when you talk about it maybe they might lock the community who is stealing. Its happened before if you reference @idealxy post.
It looks like the asset is directly ripped, so yeah I say their stuff should be taken down. There’s the RightsManager but idk if that works for UGC accessory items. If it doesn’t, there’s likely plans to add that there and you’d have a way to take things down in a different way.
I’d also like to say, you benefit in part by a lack luster copyright and DMCA system.
The avatar on the forum you have has a Repo mesh, but the devs haven’t made anything on Roblox I believe. The avatar you have on Roblox itself has a fan made mr beast shirt.
There’s nuance on small creators, indie hits, and a big creator, but I’d say you benefit from the very system that also hurts you. I mean that respectfully
Typically how DMCA’s are handled are only if the IP holder sends a DMCA. I am saying they should improve how Counters are looked into. Since a human could very clearly see the item that originally was sent a DMCA is an exact 1:1 clone of my item yet they still let it go through and will reinstate their item which is a copy of my item within 10 business days.
And to add on to this one of my friends sent a DMCA to the same people on an item they also stole from them. The person then countered my friend as well. It feels like the counter notifications just aren’t looked at thoroughly [For being something that is a legal matter]
Yeah, the IP sending the notice makes sense. Articulating the dynamic I was thinking wasn’t productive; wanting to acknowledge that. Hope this gets fixed
TankMechanic, the DMCA process on Roblox isn’t controlled by Roblox itself. It’s not a “user versus corporation” situation; it’s strictly user versus user. Roblox already removed the asset you DMCAed, and the other party used the proper legal procedure to restore it. After that, the only next step is for you to file an actual lawsuit, which costs thousands of dollars and is something most people would never pursue. In short, Roblox can’t intervene, hasn’t been able to, and won’t ever be able to change how this system works.
This really isn’t a bug report. Nothing here is a platform malfunction.
Once someone files a counter-DMCA, Roblox is legally required to follow the DMCA workflow, they don’t get to “investigate” ownership or make judgment calls at that stage.
If you believe the counter is falsified, that isn’t something support or the developer forum handles. That’s a legal dispute, and the only way to stop the reinstatement is by pursuing it through the DMCA process (i.e., filing the required legal action within the 10-business-day window).
If you think Roblox should improve creator protection or tighten review for counters, that would be a feature request, not a bug.
For the record though, if you can prove to copyright_agent@roblox.com that the information given is phony, they will reject that users counter notice entirely.
if the information they put is false, reply to the counter dmca ticket mentioning with proof like google search of address beinf fake or non residential or something , it has worked for me sometimes that they cancel the counter dmca, and i agree , ive never been so fed up and frustrated by a counter dmca system so bad, there could be bots countering dmca and roblox will accept with a blind eye , always protecting thieves
