Good to hear that Roblox will be solving this. Preston’s recent activity may or may not break Roblox’s ToS, but we must also consider the off-platform consequences.

they’re selling goods related to direct gameplay off-site for USD. That’s against the TOS

I just hope they choose to do the right thing and fight it instead of changing their own policies to allow it. I would not enjoy seeing Roblox support the selling of NFT’s.

Here is a hyper-controversial take: why not? If it is off-platform, what can/should Roblox do to control it? What stops the big game studios from having the same type of option for the headaches that is external payment processing (NFTs, Crypto, or typical credit cards)? Cloud/Web services make their money off of developers paying bills. We currently pay by our revenue, not by the services we use, which leads to some games paying much more for resources and others freeloading off of the others - including people like me. Should this be the way Roblox continues?

Edit: To be clear, because I know someone will take this out of context for NFTs: I am against the current implementation of NFTs. It is insane to think a company like VISA can handle tens to hundreds of thousands of transactions at the same energy cost for 1 Ethereum blockchain transaction (this is what the major NFTs use). Will NFTs be viable in the future? I don’t know, but I am not counting them out yet. Just… not now. Not with their current power usage and stigma.


I am overall not surprised this vague post happened, but it makes me wonder: why now? The action being “investigated” has been known for over a week now, and this post is after the transactions were made. If Roblox stepped in, clearly the initial “transactions” would have been cancelled.

Good. We need clarification on this.

So I can’t speak for Roblox here and am not a lawyer (duh) but based on the current ToS and US copyright laws, what they did shouldn’t be illegal (you own the copyright to UGC you create on Roblox, as Roblox says in their ToS), however it’s a crappy thing to do and could be against Roblox’s ToS. Also NFTs suck.

Wait… Instead of punishing a game for pretty blatantly breaking ToS, they’re going to instead rewrite the ToS to make legal what they did?

That would be pretty scummy, honestly. Only large/profitable games would have enough pull to make this happen, and it would be kinda sad if they continue to allow it without punishing them.

I think something to consider is that selling offline products that can be used in-game circumvents the sales tax Roblox charges on all sales. If this became a mainstream practice, it wouldn’t be the greatest thing.

There’s also the fact that NFT’s are environmentally unfriendly; but that is limited to the topic of NFT’s.

From a scholarly point of view though, where in the ToS is it explicitly mentioned? I think there are things in the ToS that allude to it being against rules but as I said earlier even if it’s against ToS, that’s not a violation of law so the worst thing that could happen is he gets yeeted off the platform.

Not necessarily. It could be viewed either way. Their current ToS does not say anything about the concept of NFTs, so this could be read like they’re planning on updating their ToS to better reflect that.
