This specific issue is brought to my attention due to a similar thread, Roblox sending false DMCA takedowns - #19 by TrainsRSwag, in which we have still not received any attention on this issue. Well, I’m hoping staff can at least see the repercussions of their actions, because this takedown system is completely glitched, terminating people with virtually no strikes in the DMCA system.
For this example I will be using @raskolibov’s example, but this is not exclusive to his account.
As you can see, he’s received Roblox takedown notices and the DMCA system states that he has no strikes. Roblox DMCAs are supposed to be harmless in nature, taking down items that copy Roblox limiteds, but without taking a toll on peoples accounts.
The issue is, these bans STILL stack, despite giving no strikes. As seen in this photo below from korruptkorrupt’s point of view, He has never received a single DMCA, but because of these bans stacking up on him he’s been terminated by Roblox for zero strike penalties.
Other known users affected by this glitch that I know of are ryan_theskyisRED, ftCalm and AFKEIectro, but there are hundreds others with stacked bans left on their account from this glitch.
Really Roblox, it’s either you fix it or let us counter these ourselves, because if you keep this up your going to end up leaving creators like Empyror with 15M sales termed, and I’m not sure what your end goal is after doing that.
There’s no way Roblox moderators actually think this is helping the platform by deleting these, right?
Another thing – does this not put Roblox in an risky spot to be removing peoples items, then saying they can “contest the removal”, then ignoring counter notices? Every user that has countered one of Roblox’s DMCA’s has been met with zero reply back.
I have in fact received a response back from this. I don’t think other creators care enough to take further actions and that is why they aren’t getting replies back. You see, I contacted Roblox saying that not responding to my counter or having it in review for weeks is against DMCA procedure and is against the law. I threatened with arbitration and they finally spoke. They told me that they believed my content was correctly taken down and the strike was correctly applied. However, Roblox as a company isn’t allowed to decide whether an item is acceptable when dealing with DMCA counters. The claimant must have a court order or Roblox has to reinstate the content. This is much more serious than you think and I’m one of those creators who will take it to a much more legal level.
I’m really interested to see what comes out of this. This is pretty much the only option at this point, since so many lines have been crossed and empty responses have been given. This topic dates back to months ago and even then Roblox gave nor the slightest bit of acknowledgement.
At the very least, Roblox should fix this before they ban quite literally every large UGC Creator from the platform. Think about the scale at which people have uploaded crowns and hoods with “slight resemblance” to limiteds.
I mean really take a look at what they choose to takedown, how is this even legal?
Let’s be honest no matter how many UGC creators complain about this nothing will happen, and even if something happens it will only apply to really big UGC Creators, leaving the small ones in the dust either banned or terminated.
